These Terms of Service are provided by Lantiva LLC, operating under the brand name Try OC Maker.

In these Terms, "we," "us," and "our" refer to Lantiva LLC.

These Terms of Service ("Terms") govern your access to and use of Try OC Maker, including our website, AI image and video generation tools, accounts, credits, subscriptions, and related services (collectively, the "Service").

By accessing or using the Service, creating an account, or purchasing credits or a subscription, you agree to these Terms. If you do not agree, do not use the Service.

1. About the Service

Try OC Maker provides AI-powered tools for creating original characters, images, animations, videos, character sheets, avatars, and related creative content from prompts, uploaded files, reference materials, settings, and other inputs.

The Service and its paid offerings, including subscriptions, one-time credit purchases, and generation features, are digital products and digital services delivered electronically. No purchase includes the shipment or delivery of physical goods.

The Service may use different AI models and infrastructure providers. Model availability, capabilities, prices, credit costs, and output quality may change over time.

2. Eligibility

You must be at least 18 years old and legally capable of entering into these Terms.

If you use the Service for a company or organization, you represent that you have authority to bind that entity to these Terms. You must not permit a person under 18 to use the Service through your account.

3. Accounts and Security

You agree to:

  • provide accurate and current account information;
  • keep your credentials and connected sign-in accounts secure;
  • not sell, rent, share, or transfer your account;
  • accept responsibility for activity performed through your account; and
  • promptly notify us at [email protected] if you suspect unauthorized access.

We may require identity or account verification when reasonably necessary to protect the Service, process a rights request, or investigate abuse.

4. Limited Right to Use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for lawful purposes.

You may not copy, resell, sublicense, reverse engineer, scrape, overload, disrupt, or attempt to recreate the Service, its workflows, models, security systems, or technology except where applicable law expressly permits it.

5. User Inputs

"User Inputs" include prompts, images, video, audio, character descriptions, reference files, names, settings, feedback, and other materials you submit.

You retain your rights in your User Inputs. You represent that:

  • you own or have permission to use and submit them;
  • they do not violate copyright, trademark, privacy, publicity, contractual, or other rights;
  • you have valid consent to submit another person's likeness or personal information; and
  • they comply with our Content and Acceptable Use Policy and applicable law.

You are responsible for your User Inputs and for deciding whether they are appropriate for the Service.

6. Generated Content

"Generated Content" means images, videos, animations, character designs, and other outputs produced for you through the Service.

As between you and Lantiva LLC, we do not claim ownership of your Generated Content. Subject to applicable law, third-party rights, and any plan-specific restrictions disclosed before purchase, you may use Generated Content for lawful personal or commercial purposes.

AI output may not qualify for intellectual property protection in every jurisdiction. Similar or identical output may be generated for other users, and we do not guarantee uniqueness, accuracy, non-infringement, or fitness for a particular purpose.

You are responsible for reviewing Generated Content before publishing, selling, distributing, or relying on it.

7. License Needed to Operate the Service

You grant Lantiva LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, adapt, and process User Inputs and Generated Content only as reasonably necessary to:

  • provide the generation or account features you request;
  • maintain, secure, troubleshoot, and support the Service;
  • detect, prevent, and investigate fraud, abuse, and policy violations; and
  • comply with law and enforce these Terms.

This operational license does not authorize us to use your User Inputs or Generated Content to train general-purpose or generative AI models. We may use aggregated or de-identified operational information that does not reasonably identify you or reveal your content to measure and improve Service performance.

If you intentionally publish content through a public feature, you also grant us permission to display that content as part of that feature until you remove it or close the applicable account, subject to reasonable backup and legal retention.

8. Acceptable Use

You must follow our Content and Acceptable Use Policy, which is incorporated into these Terms.

Among other things, you must not use the Service for child sexual exploitation, explicit sexual content, non-consensual intimate content, harmful impersonation, hate, harassment, graphic violence, fraud, illegal activity, rights infringement, platform abuse, or attempts to bypass safeguards.

We may block inputs or outputs and take enforcement action when we reasonably believe use violates our policies, creates risk, or is unlawful.

9. Real People, Likeness, and Consent

Do not upload or generate content involving another person's face, body, voice, identity, or personal information unless you have the legal right and valid consent to do so.

You must not create misleading endorsements, false evidence, deceptive identities, defamatory depictions, non-consensual edits, or sexualized depictions of an identifiable person.

10. Intellectual Property

The Service, including its software, interface, brand, logo, site content, workflows, templates, and technology, is owned by Lantiva LLC or its licensors and is protected by applicable law.

You may not use our marks or copy protected parts of the Service without permission. Feedback you voluntarily provide may be used by us without payment or obligation, provided we do not publicly identify you without permission.

11. Rights Complaints

If you believe content processed or displayed through the Service infringes your copyright, trademark, privacy, publicity, or other rights, contact [email protected] and include:

  • your name and contact information;
  • identification of the protected work or right;
  • the URL, asset, account, or other location of the material;
  • an explanation of the claimed infringement;
  • a statement that your report is accurate and made in good faith; and
  • proof of authorization if you act for another person.

We may request additional information and may remove or restrict material while reviewing a report.

12. Plans, Subscriptions, and Payments

The Service may offer free credits, one-time credit purchases, monthly or annual subscriptions, and other paid plans.

Prices, currencies, included credits, billing intervals, taxes, renewal terms, and material plan limits will be disclosed on the pricing page, checkout page, or billing interface before purchase. By purchasing, you authorize us and our payment providers to charge the displayed amount.

Unless clearly stated otherwise, subscriptions renew automatically for the same billing interval until canceled. You may cancel through the method described in our Refund and Cancellation Policy.

We may change future plan prices or features after giving any notice required by applicable law. A price change does not retroactively change a completed purchase.

13. Credits

Credits are a limited contractual right to access features of the Service. They are not money, stored value, securities, or transferable property and cannot be redeemed for cash.

Subscription credits may reset or expire at the end of a billing period. Promotional, bonus, or gifted credits may have separate limits and may be revoked in cases of error, fraud, or abuse. The applicable checkout or plan description controls if it states more specific terms.

14. Refunds and Cancellation

Refund eligibility, cancellation effects, processing times, annual-plan calculations, and non-refundable items are governed by our Refund and Cancellation Policy, which is incorporated into these Terms.

Nothing in these Terms limits a mandatory consumer right that cannot lawfully be waived.

15. Privacy

Our Privacy Policy explains how we collect, use, share, retain, and protect personal information, including prompts, uploads, generated content, account information, payment records, and usage data.

You are responsible for having a lawful basis to submit personal information about another person.

16. Third-Party Services

The Service may rely on or link to third-party authentication, payment, hosting, storage, analytics, safety, AI model, and infrastructure services. Third-party services may have their own terms and privacy practices.

We are not responsible for third-party services that we do not control, but this does not limit responsibilities that applicable law places on us for our selection or use of service providers.

17. AI Output and Service Disclaimer

AI systems are probabilistic. Outputs may be incomplete, unexpected, inaccurate, offensive, low quality, or similar to existing material. We do not guarantee that output will:

  • match your prompt or expectations;
  • be unique or free of third-party claims;
  • be accepted by a marketplace, platform, publisher, or business partner; or
  • satisfy professional, legal, commercial, or technical standards.

You use and distribute output at your own risk and should apply appropriate human review.

18. No Professional Advice or High-Impact Reliance

The Service provides creative tools, not legal, medical, financial, safety, or other professional advice.

Do not use output as authoritative evidence, identity verification, or the sole basis for a decision affecting a person's rights, employment, housing, credit, insurance, education, healthcare, legal status, or access to essential services.

19. Availability and Changes

We aim to operate a reliable Service but do not guarantee uninterrupted, secure, or error-free availability. Maintenance, provider outages, network failures, safety incidents, or events outside our reasonable control may affect access.

We may add, change, limit, suspend, or discontinue features, models, plans, or credit costs. Where required, we will provide notice or remedies under applicable law.

20. Suspension and Termination

You may stop using the Service at any time.

We may restrict, suspend, or terminate access if you violate these Terms, fail to pay, create legal or security risk, abuse the Service, or if action is required by law or a service provider. Where appropriate, we may provide notice and an opportunity to appeal.

Upon termination, your right to use the Service ends. Content and account data may be deleted or retained as described in the Privacy Policy and as required for billing, security, disputes, or legal compliance.

21. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

These disclaimers do not exclude warranties or consumer protections that cannot lawfully be excluded.

22. Limitation of Liability

To the fullest extent permitted by law, Lantiva LLC and its owners, team members, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, business, reputation, opportunities, or expected savings.

Our total liability arising from the Service will not exceed the amount you paid to Lantiva LLC during the 12 months before the event giving rise to the claim, or USD 100 if you paid nothing, unless applicable law requires a different result.

23. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Lantiva LLC and its owners, team members, affiliates, and service providers from third-party claims, losses, and reasonable costs arising from your User Inputs, Generated Content, unlawful use, or violation of these Terms or another person's rights.

This section does not apply where prohibited by consumer law or to the extent a claim results from our own unlawful conduct.

24. Governing Law and Disputes

Applicable mandatory consumer protections remain available to you. Lantiva LLC is organized in Wyoming, United States. Nothing in these Terms is intended to deprive you of the law or courts available under applicable law.

Before filing a claim, please contact [email protected] so we can attempt to resolve the issue informally. This informal process does not suspend a legal deadline unless applicable law says otherwise.

25. Changes to These Terms

We may update these Terms as the Service, law, or our practices change. We will update the date above and provide additional notice of material changes where required.

Changes apply prospectively from their effective date. If you do not agree to updated Terms, you must stop using the Service and cancel any active subscription.

26. General

These Terms, together with the Privacy Policy, Content and Acceptable Use Policy, Refund and Cancellation Policy, and any plan-specific terms shown before purchase, form the agreement between you and Lantiva LLC regarding the Service.

If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer your account or these Terms without our permission. We may transfer these Terms as part of a merger, financing, reorganization, or sale of the Service, subject to applicable law.
