This Privacy Policy explains how Try OC Maker collects, uses, discloses, retains, and protects personal information when you visit https://tryocmaker.com, create an account, upload content, use AI generation features, purchase credits or subscriptions, or contact us.

For purposes of this Policy, Lantiva LLC, operating under the brand name Try OC Maker, is the controller responsible for the personal information described below. This Policy should be read with our Terms of Service and Acceptable Use Policy.

1. Scope and Eligibility

This Policy applies to visitors, account holders, and customers of the Service. The Service is intended only for people aged 18 or older.

It does not govern a third-party website or service that you access independently, even if the Service links to it.

2. Information You Provide

We may collect:

  • account information such as email address, display name, profile image, account identifier, and authentication details;
  • information received from a connected sign-in provider, such as Google, according to the permissions you approve;
  • support requests, feedback, survey responses, and other communications;
  • transaction-related information such as billing email, order and transaction identifiers, amount, currency, payment status, subscription status, refunds, and chargebacks; and
  • information you submit when exercising privacy rights or reporting safety, legal, or intellectual property concerns.

Payment providers process full card, bank, or wallet credentials. We do not intend to store complete card numbers or security codes.

3. AI Inputs, Uploads, and Outputs

To provide the Service, we may process:

  • prompts, character descriptions, style instructions, and generation settings;
  • uploaded images, video, audio, and reference materials;
  • faces, likenesses, voices, or other personal information contained in submitted media;
  • Generated Content, including images, animations, videos, avatars, and character sheets;
  • task status, model selection, credit use, safety signals, and output metadata; and
  • saved projects and generation history associated with an account.

You must have a lawful basis and all required permissions before submitting personal information about another person.

4. Information Collected Automatically

When you use the Service, we may automatically collect:

  • IP address, approximate location derived from IP, browser, device, operating system, and language;
  • pages viewed, referring pages, interactions, feature use, session timing, and diagnostic events;
  • login, security, fraud, rate-limit, and error logs;
  • cookie identifiers and analytics information when analytics is enabled; and
  • locally stored drafts, preferences, or generation settings on your device.

Some generation forms use browser local or session storage so a draft can survive navigation or a sign-in flow. This locally stored information remains on your device until the application or you removes it, or until you clear browser storage.

5. How We Use Information and Our Legal Bases

We process personal information for the following purposes and legal bases, as applicable:

  • Contract: to create and manage accounts, authenticate users, provide requested generations and downloads, maintain history, allocate credits, process purchases, handle cancellations and refunds, and provide support.
  • Legitimate interests: to secure and troubleshoot the Service, prevent fraud and abuse, understand performance, improve workflows, protect users and rights holders, and maintain reliable operations, where those interests are not overridden by your rights.
  • Consent: for marketing, connected services, or another activity where we specifically request consent. You may withdraw consent prospectively.
  • Legal obligations: to maintain required transaction records, respond to valid legal requests, protect child safety, enforce rights, resolve disputes, and comply with tax, accounting, consumer, privacy, and other applicable laws.

6. AI Processing and No Model Training

We process User Inputs and Generated Content to perform the generation you request and to provide related history, safety, troubleshooting, and support functions.

We do not use your prompts, private uploads, or Generated Content to train our own or third-party general-purpose or generative AI models.

We may use aggregated or de-identified operational information that does not reasonably identify you or reveal your content to measure reliability, credit usage, error rates, model performance, and product experience.

7. Safety Review

Automated systems may inspect prompts, uploads, outputs, metadata, and usage patterns to identify fraud, security threats, illegal content, or violations of our policies.

Authorized personnel or service providers may review relevant material when reasonably necessary to investigate a flagged event, respond to a report, troubleshoot a problem, enforce our policies, or comply with law. Access is limited according to role and purpose.

Serious violations may lead to blocked generations, content removal, account restriction, preservation of records, or reporting where required or permitted by law.

8. Cookies and Similar Technologies

We may use cookies, local storage, session storage, pixels, and similar technologies for:

  • authentication and session continuity;
  • security, fraud prevention, and rate limiting;
  • remembering language, draft, and product preferences;
  • preserving generation form state;
  • measuring performance and errors; and
  • audience and usage analytics.

Some technologies are necessary for requested features. When Google Analytics is configured, we use it for audience, performance, and product-use measurement based on our legitimate interest in understanding and improving the Service.

The Google tag is configured to disable Google signals and advertising-personalization signals. We do not use this analytics configuration for cross-context behavioral advertising.

You can control cookies and browser storage through browser settings. Blocking necessary storage may prevent account, draft, generation, or analytics features from working. Where applicable law provides an opt-out right, we honor it as described in Section 10.

9. How We Disclose Information

We may disclose information to service providers that support:

  • authentication and account access;
  • cloud hosting, content delivery, databases, and media storage;
  • AI model inference and generation infrastructure;
  • payments, subscription administration, refunds, and fraud prevention;
  • analytics, diagnostics, and performance monitoring;
  • email delivery and customer support;
  • safety, moderation, security, and abuse prevention; and
  • professional legal, accounting, insurance, or audit services.

Providers may process information only for authorized services and subject to appropriate contractual or legal obligations.

We may also disclose information:

  • when you direct or consent to the disclosure;
  • to comply with law, legal process, or a valid government request;
  • to protect the rights, safety, and security of users, Try OC Maker, or others;
  • to investigate fraud, abuse, payment disputes, or rights complaints; or
  • in connection with a merger, financing, acquisition, restructuring, or sale, subject to applicable safeguards.

10. No Sale of Personal Information

We do not sell personal information for money.

We do not knowingly use personal information for cross-context behavioral advertising. If our practices change, we will update this Policy and provide any notice or opt-out mechanism required by law.

Where applicable law recognizes browser-based opt-out signals such as Global Privacy Control, we will honor a valid signal for the browser or device as legally required.

11. Public and Shared Content

If the Service offers a gallery, public profile, sharing page, or community feature, content you intentionally publish may be visible and copied by others.

Do not publish personal information or content that you do not want others to access. Removing public content may not delete copies already made by another person or retained for security, disputes, or legal compliance.

12. Data Retention

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, including to:

  • maintain your account and provide requested history or projects;
  • complete generations, payments, refunds, and support;
  • secure the Service and prevent fraud or repeat abuse;
  • meet tax, accounting, consumer, and legal obligations;
  • establish, exercise, or defend legal claims; and
  • resolve disputes and enforce agreements.

Retention depends on the type of information, account status, sensitivity, legal requirements, operational need, and risk. You may delete individual generated items where the feature is available or request account or personal-information deletion by contacting us.

Deletion may not immediately remove information from encrypted backups, security logs, transaction records, fraud-prevention records, or legal holds. We isolate or remove remaining information when the relevant retention purpose ends.

13. Security

We use reasonable technical, administrative, and organizational measures designed to protect information, such as access controls, transport encryption, service-provider controls, monitoring, and restricted personnel access.

No online service is completely secure. You are responsible for protecting your account and should notify [email protected] if you suspect unauthorized access.

14. International Data Transfers

We and our service providers may process information in countries other than where you live. Those countries may have different data-protection laws.

Where required, we use an applicable legal transfer mechanism or other safeguards. You may contact us for information about safeguards relevant to your personal information.

15. Your Privacy Rights

Depending on your location, you may have rights to:

  • access or obtain a portable copy;

17. Marketing and Service Communications

We may send transactional messages about authentication, security, generations, purchases, subscriptions, support, and policy changes as necessary to provide the Service.

Where permitted, we may send product news or promotions. You may unsubscribe from marketing messages, but you may continue to receive necessary service communications.

18. Children's Privacy

The Service is not intended for anyone under 18, and we do not knowingly collect personal information from a person under 18.

19. Third-Party Links and Services
